General information

The Global Portal (My Ship) MyShip.com was created to bring together the international community of seamen and contract officers, thus enabling them easy and quick communication with one another. Moreover, our Portal allows getting in touch with recruitment agencies and a lot more (in preparation).

We assume that in order to make new contacts via MyShip.com you cannot be fully anonymous any longer and you agree to such a state of affairs. Such an assumption corresponds to the special specification of your professional group. By registering in our Portal, you accept this document and you state that you have become acquainted with the Warnings, also that you agree to have selected information made available to other registered users of the Portal, seamen and recruitment agencies or advertisers.

YOU BEAR THE SOLE RESPONSIBILITY FOR THE CONTENTS YOU PLACE IN MY SHIP SERVICES, VIA THESE SERVICES AND IN RELATION TO THEM, AS WELL AS FOR ANY MATERIALS AND INFORMATION CONVEYED TO OTHER MEMBERS AND FOR MUTUAL RELATIONS WITH OTHER USERS.

Data collection

MyShip.com collects information in line with the standards generally accepted in the Internet, technical standards and social rules. Our Portal does not engage in aggressive policies of data acquisition and its utilisation for purposes other than use in the crewing sector well-understood by seamen and recruitment agencies.

Seamen’s data collection

When using MyShip.com, you leave a lot of data, for instance: your personal data, your address, specific professional data, contacts, opinions, comments and the like, intentionally published on the Portal's website and collected in its data base, as well as information regarding your activeness on the Portal. If you do not wish to make any piece of information available, simply do not enter it or remove it. We, on our part, do not force you to leave any data, except that given in the registration form. The Portal shall not be responsible for conformity of the data left by users with real data. For the purposes of the Portal we automatically collect a great deal of other data, like for instance IP, cookies, history of visits and a lot of other.

Making data available “Seaman – Seaman”

There are two privacy levels on our Portal.

The first one, when the person visiting a seaman’s Profile is not his colleague. In that case such a person has no access to selected information, for instance specific contact data, like telephone number and a lot of other.
The second level requires the status “My colleague”, and provides full access by people you have intentionally entered to all the information you published.

Making data available to others

We cannot rule out that your data will be indexed in internet explorers. For the purposes of the Portal we have insight into the whole contents published by all users.

The companies cooperating with the Portal, for instance suppliers of hosting services, programming companies and others may have access to the whole contents, however before access is allowed to any companies MyShip.com requires an agreement to be concluded, which stipulates, inter alia, enforcement of respect for privacy of settings and strictly limits their use and storage.

We may be obliged to disclose information about users on the grounds of a legitimate demand, such as a call or order issued by a court of law, or in accordance with applicable law. In addition, we may make all information available to protect our interests or possessions, to prevent malfeasance or other illegal activities perpetrated on the Portal or when such a threat clearly occurs. This may include exchange of information with other companies, lawyers, agents or government agencies.

Security

Despite steps taken to secure all data we cannot guarantee that it will not be stolen, intentionally damaged or partially used without our consent and without our knowledge.

MyShip.com takes appropriate precautions to protect the data base, using all means available to us.

ShipsPedia

Part of MyShip.com, for instance ShipsPedia, plays the role of an open encyclopaedia, which means that it is created free of charge by volunteer seamen, who thus develop the common pool of knowledge. Such solutions allow each Internet user to change the contents found on the Portal’s selected sites. MyShip.com is not obliged to verify the contents entered by seamen. This is not to say that you will not be able to find a lot of valuable information, however you should be aware that MyShip.com MAY NOT guarantee in any way the credibility of ANY piece of information found on its sites. There is always a possibility that someone might have entered outdated contents, perpetrated an act of vandalism or might have intentionally wanted to mislead others. We assume that this community is interested in having the best possible contents quality, hence voluntarily entered information is useful, in our opinion.

Photographs

The responsibility for a photograph rests solely with the user who has put it on MyShip.com. server. The Portal shall not bear any responsibility for violation of copyright by users. Moreover, you are reminded of this in Warnings.

Pornographic contents and pictures

We do not prohibit the publication of erotic contents or pictures, however you are admonished against publication of pornographic materials or materials compromising the dignity of any person. You do it at your own risk. We may remove revealed materials without notification to the person they have been put by.

Discrimination

You are admonished against publication of contents violating widely accepted social or religious values. You do it at your own risk. We may remove revealed materials without notification to the person they have been put by.

Opinions and comments

Every day MyShip.com publishes a great deal of contents in the nature of opinions or comments. Opinions or comments are put voluntarily and spontaneously by users, who shall be responsible for their contents. Users have additionally been advised in Warnings of the danger following from their publication.

Since the contents put by users is in various languages and is meant for different purposes, we do not have influence on it. It is not possible to moderate that content, but only to remove it as requested by another user or entity, provided it is justified.

Change or removal of Information

Removed information may be retained in extra copies for a reasonable period of time, but it will not be generally available to users of the Portal. Part of the information, such as opinions and comments, will be retained, however after the account has been removed the source will be left anonymous.

Data following profile removal

Due to the organised nature of information exchange, part of the data, mostly photos in the ship gallery, opinions and comments, cannot be removed for good as it is related to other information placed by different users, making up a single whole; this is called a permanent trace of presence. This does not refer to photos in the profile’s private gallery.

Rights of the Portal

This Agreement and any amendments thereto placed on MyShip.com shall be valid throughout the whole time you use the services provided by MyShip.com. You may resign Membership at any time and for any reason, following appropriate commands in the Profile Settings window. MyShip.com may take membership away from you at any time and for any reason or without a reason, with prior notification or explanation or without such a notification or explanation, not bearing any responsibility related thereto. Moreover, MyShip.com reserves the right to reject, refuse to enter or remove at their own discretion the information placed by you (including, inter alia, private messages, e-mails and other (referred to collectively as “messages or information”) or to refuse, restrict, suspend or close your access to all or part of the services provided by the Portal at any time and for any reason or without a reason, with prior notification or explanation or without such a notification or explanation, not bearing any responsibility related thereto.

Gross copyright violation

If you think that your photo or any other information has been copied and placed in the Portal’s services or via these services in a way violating copyrights, please send a notification of the imputed violation to a representative of PortalGuard. The notification to PortalGuard of an alleged violation may also be sent by electronic mail to the following e-mail address: PG@MyShip.com. The Portal provides specific instruments and technologies, which will facilitate control of the use of their materials by those holding copyrights. Advertisements

MyShip.com publishes advertisements in the whole Portal. Advertisements may be supplied to groups of users, making use of the information included in the profile.

Amendments to the agreement

If we make any amendments to this agreement, this will be indicated by the date at the top of the site after any essential amendments have been made to that agreement.

Failures and repairs

Portal MyShip.com is not free of faults at any stage of its operation. This may cause interruptions in the site’s operation or other malfunctions. After a failure or an error has been detected, repair will be made, using all our capacities.

Room

MyShip.com reserves the right to restrict the room for storing all contents and materials placed by a user on the Portal’s services, via these services or in relation to them.

Copyrights to MyShip.com

We would like to remind imitators that the name of the Portal, its layout and concept, graphic presentation, software and data base are under legal protection.

Beta Version

MyShip.com Beta version may have operational faults and there may be problems using all security rules, confidentiality of data, contents processing.

Conclusion

We reserve the right to make amendments to this agreement at any time. In the absence of any essential amendments and explanations, a supplemented agreement will come into force forthwith, and in case of essential amendments, you will be notified thereof. If the amendments are unacceptable to you, you should erase your profile. We encourage regular reference to this agreement. Unless provided otherwise, our current agreement refers to all the information we have of You and Your account.

Limitation of liability. MY SHIP SHALL NOT IN ANY WAY BEAR COMPENSATORY LIABILITY TO YOU OR THIRD PARTIES COVERING COMPENSATION FOR INDIRECT DAMAGE, CONSEQUENTIAL DAMAGE, EXEMPLARY DAMAGE, COLLATERAL AND SPECIAL DAMAGE AND COMPENSATORY DAMAGE, INCLUDING, INTER ALIA, ALSO COMPENSATION OF THE KIND FOLLOWING FROM LOST BENEFITS CAUSED BY YOUR USE OF MY SHIP SERVICES OR SUBLINKED SERVICES, EVEN IF MY SHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. REGARDLESS OF ANY PROVISIONS OF THIS AGREEMENT HAVING A DIFFERENT EFFECT, THE LIABILITY OF MY SHIP TO YOU OF ANY KIND, REGARDLESS OF THE FORM OF OPERATION, SHALL ALWAYS BE LIMITED TO THE AMOUNT WHICH YOU HAVE PAID MY SHIP FOR USING MY SHIP SERVICES DURING THE EFFECTIVE MEMBERSHIP PERIOD.

The administrator reserves the right to send Users unexpected messages. These include information referring directly to the functioning of the Service (for instances changes in the functioning), or else non-profit-making letters (for instance greetings, information about new messages, system messages) as well as profit-making contents (for instances advertisements and information).
